Terms - End User License Agreement

Overview

This End User License Agreement ("Agreement") is between you ("User" or "You") and VSB DEVS ("Company," "We," or "Us") and governs your use of the PhotoCollageApp mobile application ("App"). By downloading, installing, or using the App you agree to be bound by this Agreement. If you do not agree, do not download or use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service and Apple’s Standard EULA. This license is solely for personal, non-commercial use unless we explicitly provide written permission for commercial usage.

2. Restrictions

• • You must not copy, modify, distribute, reverse engineer, decompile, or attempt to extract the source code of the App.
• • You may not use the App for any unlawful, harmful, defamatory, abusive, or fraudulent activity.
• • You must not interfere with, disrupt, or attempt to bypass any security features of the App.
• • Do not use images, photos, or content within the App unless you have full legal rights to them.

All rights not expressly granted are reserved by VSB DEVS.

3. User Content & Responsibility

The App allows you to create collages using your own photos, text, emojis, and other visual elements. You are fully responsible for ensuring you own necessary rights to all photos or content you import into the App, for any content you create or share, and for complying with copyright, privacy, and local laws. We do not access, upload, or store your photos, everything stays on your device unless you share it externally.

4. Privacy & Data Handling

Your privacy is important to us. We do not collect or store personal data. The App requires photo & storage access solely for selecting and saving collages locally. We use Google Firebase Crash Analytics to improve performance; this may collect non-personal technical data (e.g., device type, crash logs). No photos or personally identifiable information are uploaded to our servers. Review our full Privacy Policy for more details.

5. Intellectual Property

All trademarks, assets, layouts, text, filters, UI elements, and other intellectual property within the App remain the exclusive property of VSB DEVS. Your content remains yours. The App does not claim ownership over your photos, collages, or creations.

6. Subscriptions, Purchases & Payment

If the App offers paid features, subscriptions, or in-app purchases: payments are processed through Apple. All refunds are subject to Apple’s refund policies. Subscription access will continue until canceled through your Apple ID settings. We do not process or store payment information.

7. Third-Party Services

The App may integrate third-party services such as Google Firebase for crash analytics. These services have their own privacy policies. Continued use of the App indicates your consent to such integrations.

8. Disclaimer of Warranty

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee error-free performance, uninterrupted availability, or that outputs will meet your expectations. Your use of the App is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, VSB DEVS shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the App. Some jurisdictions may not allow certain limitations; in those cases our liability is limited to the maximum extent permitted by law.

10. Termination

We may suspend or terminate this Agreement if you violate any terms here, misuse the App, or engage in unlawful activities. Upon termination, you must stop using the App and delete it from your devices.

11. Updates and Modifications

We may update, modify, or discontinue features at any time. Continued use after changes constitutes acceptance of the updated Agreement. We may revise this EULA periodically and you are advised to review it from time to time.

12. Legal Compliance

You agree to comply with all applicable laws, including copyright laws, privacy and data protection regulations, and local/international content use laws.

13. Governing Law

This Agreement is governed by the laws of India. Any dispute shall be resolved in the courts of Nashik, Maharashtra, India unless local law requires otherwise.

14. Third-Party Beneficiary

Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement. By using the App you acknowledge and agree that Apple has the right to enforce this Agreement if necessary.
